1.2 Services means any waste removal, waste collection, bulky item removal, house clearance, office clearance, garden waste clearance, construction or refurbishment waste removal, or related services provided by us.

1.3 Booking means a confirmed request for Services, whether made by telephone, email, online form, or in writing.

1.4 Waste means any items, materials or rubbish presented by the Customer for removal as part of the Services, excluding prohibited or hazardous materials as defined in these Terms and by applicable law.

1.5 We, us or our means the operator of Rubbish Removal Bermondsey providing the Services.

1.6 Site means the property, premises or location where the Services are carried out and where the Waste is collected from.

2. Scope of Services

2.1 We provide on-demand waste collection and rubbish removal services, including loading, transportation and disposal or recycling of Waste, subject to these Terms and applicable waste management regulations.

2.2 Our Services are generally provided within our stated service area. Acceptance of a Booking outside our usual area is at our sole discretion, and may be subject to additional charges.

2.3 We reserve the right to refuse to provide Services where it would be unsafe, unlawful, impractical, or where the Waste is not suitable for collection under these Terms.

3. Booking Process

3.1 Bookings can be made by telephone, email, or any other method we make available. At the time of booking, you must provide accurate information regarding:

(a) the type and approximate volume or weight of Waste to be collected

(b) the location and access details for the Site

(c) any parking, loading or time restrictions

(d) any known hazards, such as limited access, fragile surfaces, or potentially hazardous materials.

3.2 Any quotation provided before the team attends the Site is indicative only, based on the information you provide. The final price will be confirmed by our team on arrival, once they have inspected the Waste and assessed access, parking and any other relevant factors.

3.3 A Booking is considered confirmed when we have agreed a time and date with you and, where required, you have accepted our quotation and any applicable call-out or attendance fee.

3.4 We may require your full name, address, contact number and email address in order to complete a Booking and issue confirmation and documentation.

3.5 We will use reasonable efforts to arrive at the agreed time, but timings are estimates only and may be affected by traffic, weather, previous jobs or other circumstances beyond our control. We will not be liable for any loss or inconvenience arising from delays, although we will aim to keep you informed of any significant changes to the estimated arrival time.

4. Access and Parking

4.1 You are responsible for providing safe, reasonable and lawful access to the Site for the duration of the Services.

4.2 You must ensure that suitable parking is available close to the Site. Any parking charges, permits or fines incurred as a direct result of carrying out the Services may be added to your final invoice where they arise from circumstances under your control or from incomplete or inaccurate information provided by you.

4.3 If adequate access or parking is not available, we may:

(a) refuse to carry out the Services, in which case a call-out or cancellation charge may apply; or

(b) agree to proceed subject to additional labour or waiting time charges, which will be confirmed to you before work continues.

5. Waste Presentation and Prohibited Items

5.1 You must ensure that all Waste to be collected is clearly identified and made accessible to our team. If certain items are not meant to be removed, they must be clearly separated and indicated to us.

5.2 The following items are considered hazardous or prohibited and will not normally be collected:

(a) asbestos or asbestos-containing materials

(b) clinical, pharmaceutical or medical waste

(c) chemicals, solvents, oils, paints, or pressurised containers not declared and agreed in advance

(d) gas bottles, fuel, explosives or fireworks

(e) large quantities of liquid waste

(f) any substances classified as hazardous under applicable waste regulations, unless we have specifically agreed in writing to collect them and you have complied with all special requirements.

5.3 We reserve the right to refuse to handle any item we reasonably believe to be hazardous, illegal, unsafe to move or not in compliance with applicable waste legislation.

6. Pricing and Quotations

6.1 Prices for our Services are generally based on volume, weight, labour time, access conditions and type of Waste, together with any applicable disposal or recycling charges.

6.2 Any quotation provided before assessment at the Site is an estimate only. The final price will be confirmed on Site once our team has inspected the Waste. If you do not agree to the final price, you may decline the Service, but a call-out or attendance fee may apply if our team has already arrived at the Site.

6.3 Where the scope of work changes during the job, for example due to additional Waste or unforeseen difficulties, we may revise the quoted price and will seek your agreement before proceeding.

7. Payment Terms

7.1 Unless agreed otherwise in writing, payment is due in full on completion of the Services and before our team leaves the Site.

7.2 We accept the forms of payment we specify from time to time, which may include cash, debit or credit card, or bank transfer. We do not accept cheques unless agreed in advance.

7.3 For commercial Customers, we may at our discretion agree to provide Services on account, subject to satisfactory credit checks and agreed payment terms. Invoices for account Customers are payable within the period specified on the invoice.

7.4 If payment is not made when due, we reserve the right to charge interest on overdue amounts at the statutory rate applicable to commercial debts, and to recover any reasonable costs incurred in pursuing outstanding balances.

8. Cancellations, Rescheduling and Waiting Time

8.1 You may cancel or reschedule a Booking by contacting us directly. We ask that you give as much notice as reasonably possible.

8.2 We reserve the right to apply a cancellation charge where a Booking is cancelled or significantly amended within a short period before the scheduled arrival time, or where our team attends the Site and is unable to carry out the Services for reasons beyond our control, including but not limited to:

(a) failure to provide access to the Site

(b) failure to obtain necessary permissions or consents

(c) the Waste being materially different from that described at the time of Booking

(d) safety or legal concerns preventing us from carrying out the work.

8.3 Where our team is kept waiting at the Site for reasons outside our control, we may apply a reasonable waiting time charge, which will be explained to you before it is incurred where possible.

8.4 We reserve the right to cancel or postpone a Booking at any time due to circumstances beyond our control, including but not limited to extreme weather, vehicle breakdown, staff illness, or regulatory changes. In such cases, our liability will be limited to rescheduling the Booking or, if this is not possible, refunding any amounts you have already paid for the affected Services.

9. Customer Obligations

9.1 You warrant that you are the owner of the Waste or have full authority from the owner to arrange for its removal and disposal.

9.2 You must ensure that the Site is safe and suitable for our team to work, and that all necessary permissions, permits and consents have been obtained in advance, including any required consent from landlords, neighbours or managing agents.

9.3 You agree to provide accurate and complete information about the Waste and the Site, and to inform us promptly of any changes which may affect the Services.

9.4 You must supervise children, pets and other persons at the Site to ensure they do not interfere with the performance of the Services or create safety risks.

10. Waste Handling and Duty of Care

10.1 We will handle, transport and dispose of Waste collected under these Terms in accordance with applicable UK waste management legislation and our duty of care as a waste carrier.

10.2 We will use licensed and compliant facilities for the disposal, transfer or recycling of Waste, and will aim to minimise landfill use where reasonably practicable.

10.3 Once Waste has been loaded onto our vehicle and payment has been made, ownership of the Waste transfers to us, except in cases where the Waste includes prohibited or misdeclared items that we are not lawfully able to accept.

11. Damage and Liability

11.1 We will exercise reasonable skill and care while providing the Services. However, you acknowledge that movement of heavy items, access through tight spaces, and removal of bulky waste may carry an inherent risk of minor damage to surfaces, fixtures or fittings.

11.2 We will not be liable for:

(a) pre-existing damage or defects

(b) damage resulting from inadequate protection of surfaces or items where we have advised you of the risk and you have asked us to proceed

(c) damage to concealed or hidden services such as pipes, cables or wires unless we have been informed of their exact location in advance

(d) any indirect or consequential loss, including loss of profit, loss of business, or loss of opportunity.

11.3 Our total liability to you in respect of any claim arising out of or in connection with the Services, whether in contract, tort or otherwise, shall be limited to the price paid or payable for the specific Services giving rise to the claim, except where such limitation is not permitted by law.

11.4 Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other matter in respect of which liability cannot lawfully be excluded or limited.

12. Insurance

12.1 We maintain liability insurance appropriate to the nature of our rubbish removal activities. Details of our current insurance cover are available on request.

12.2 You are responsible for ensuring that your own insurance policies, including building and contents insurance, are adequate and remain in force during the provision of the Services.

13. Complaints and Disputes

13.1 If you are dissatisfied with any aspect of the Services, you must notify us as soon as reasonably possible, ideally within 48 hours of completion, providing full details of your concerns.

13.2 We will investigate any complaint in good faith and may request photographs, evidence or access to the Site in order to assess the issue.

13.3 Our aim is to resolve complaints promptly and fairly, which may include rectifying any identified shortcomings in the Services where appropriate.

14. Data Protection and Privacy

14.1 We collect and use personal information, such as your name, address, contact details and payment information, for the purposes of managing Bookings, providing Services, processing payments and maintaining records.

14.2 We will handle your personal data in accordance with applicable data protection law and will take reasonable steps to protect it against unauthorised access, loss or misuse.

14.3 We may retain your details for a reasonable period in order to comply with legal and regulatory requirements and to maintain accurate business records.

15. Amendments to These Terms

15.1 We may update or amend these Terms and Conditions from time to time to reflect changes in our practices, legal requirements or industry standards.

15.2 The version of the Terms in force at the time of your Booking will normally apply to that Booking. We will make updated Terms available on request and may notify you of significant changes where appropriate.

16. Severability

16.1 If any provision of these Terms is found by a court or other competent authority to be invalid, unlawful or unenforceable, that provision shall be deemed deleted, but the remainder of the Terms shall continue in full force and effect.

17. Governing Law and Jurisdiction

17.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services, shall be governed by and construed in accordance with the laws of England and Wales.

17.2 You and we agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms or the Services, provided that this shall not limit any consumer rights you may have to bring proceedings in another jurisdiction where such rights cannot lawfully be restricted.

18. Entire Agreement

18.1 These Terms and Conditions, together with any written quotation or confirmation we provide to you, constitute the entire agreement between you and us relating to the Services and supersede any prior agreements, understandings or arrangements, whether oral or written.

18.2 You acknowledge that you have not relied on any statement, promise or representation made on behalf of Rubbish Removal Bermondsey that is not expressly set out in these Terms.
